BRO Terms of Use
By completing the Broken Reality Online ("BRO") registration process and creating a BRO Account, you become a BRO Member and are subject to all terms, rights, and conditions applicable to BRO Membership. We reserve the right to modify, alter, or update the terms and conditions of this agreement without prior notice at any time to reflect changes in the services provided, changes in laws affecting services, or for other reasons that may benefit the game. Modifications shall become effective immediately upon being posted at the brokenrealityonline.com website. Your continual use of the service after amendments are posted constitutes an acknowledgement and acceptance of the agreement and any modifications.
Description of Service:
The team at BRO will put forth its best effort to make the game run flawlessly. As with any computer device, failures, unexpected loss of data, or faulty programming can and do occur. In the case that such an event does occur, every reasonable effort is made to resolve the issue as quickly as possible. BRO is not responsible for any loss should such an event occur and does not entitle the user to claim the recovery of his/her account status before the occurrence.
Age requirements:
BRO is not intended for persons under 13 years of age. Some content may be inappropriate for young children. By joining you are stating that you are thirteen years or older.
Use of Site:
The website at brokenrealityonline.com is provided on an "as is" basis. You assume full responsibility for your use of the site and may not hold BRO or any of its administrators liable under any circumstances.
Limitation of Liability:
BRO shall not be liable for any incidental, indirect, or consequential damages. Including but not limited to lost profits, loss of information, or loss of use arising out of related use of the service, whether such damages occur, even if BRO has been advised of the possibility of such damages. The limitation described above may not apply to you. In those states, BRO liability is limited to the greatest extent permitted by law.
Indemnification:
You agree to indemnify, defend and hold harmless BRO, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the service from and against all losses, expenses, damages and costs, including attorneys' fees, resulting from any violation of this Agreement or the BRO code of conduct (including negligent or wrongful conduct) by you or any other person accessing the service.
Macros and 3rd party Scripts:
BRO rewards players for their time spent on the game. Anyone found to be using macros, automated scripts or any 3rd party program that gives the user an unfair advantage will be subject to disciplinary action; not limited to having the infringing account temporary banned or deleted.
Game bug abuse:
Depending on the severity, game bug exploit will result in anywhere from a 30-day ban term to account deletion. Bugs, loopholes, security flaws, or any inconsistencies in the game should be immediately reported to the staff through the in game forums or by mailing one of the administrators.
Scams:
No impersonating Staff or other players. This includes telling players you are Staff.
No scamming other players. If you say you will do something, you best be prepared to do it. The above offenses are subject to disciplinary actions; not limited to having the infringing account temporary banned or deleted based on the severity of the offense.
Communication:
Excessive cursing or flaming (insulting for the sake of insulting) will not be tolerated in any in game communication (Message Boards, Messages, or Chat). Spamming of the Message Boards, or any player's News or Mails is not allowed. You may not beg for game funds via Mails or on the Message Boards. Prejudice comments are not welcome on BRO. Prejudice includes, but is not limited to: racism, sexism, ageism, and any other comments based upon the sex, race, religion, or creed of a group or individual. If you have opinions that could be regarded by Staff to be prejudices, please keep them to yourself while interacting with others in the game. This criteria also applies to character names.
Message Board signatures may not be more than ten lines. The judgment of how many lines a signature is will be made by Staff, so please keep in mind that not all players use the same monitor resolution when making your signature. Additionally, please do not make any line of your signature long enough to stretch the screen of other players.
No pornography. BRO is for players age 13 and older and therefore may not have pornography. If there is any question in your mind about the acceptability of a comment, picture, or link, just don't post it.
Violations of the above are subject to disciplinary actions; not limited to having the infringing account temporary banned or deleted based on the severity of the offense.
Copyright, Trademark, and Licensing Information:
All content included or available on BRO are protected by international copyright and trademark laws. You may not modify, copy, reproduce, republish, or distribute any material on the site: including text, graphics, code and/or software without express written consent of an authorized officer of BRO. You also grant BRO the right to use any ideas you submit to any public areas of the site. You agree that you shall have no recourse against BRO for any alleged or actual infringement of any proprietary right in your communications to BRO.
Furthermore, your account and any virtual items contained in the account are the property of BRO. In-game Property may not be sold for real life money or funds in another game. This includes selling money, points, donations, accounts, or anything else that is transferable in BRO. Additionally, you may not pay for items transferred in another game with BRO funds. Violations of these rules are subject to disciplinary actions from the BRO Staff.
User generated content:
To the extent that portions of this site provide users an opportunity to post and/or exchange information and/or ideas, and opinions ("postings") in chat rooms and message boards and via private messages, and in descriptions of guilds, please be advised that postings do not necessarily reflect the views of BRO. Although the administrative staff may periodically monitor exchanged and posted information, in no event does BRO assume or have any responsibility or liability for any postings or any claims, damages or losses resulting from their use and/or appearance on or in conjunction with this site or elsewhere. Players are solely responsible for the content of their messages and postings, however, BRO reserves the right to edit, delete or refuse postings that violate these Terms of Use as well as revoke the privileges of any player who does not comply with the Terms of Use.
Membership:
I. Once you register and create an account you are a member.
II. BRO is free to play, however, donators will be rewarded with in-game assets. BRO reserves the right to make changes to the donator area without notice. Every member (donator or not) is treated fair and equally. Donating does not make you exempt from the rules.
Member Accounts:
Upon registration all members of BRO shall receive one account and a password. You will use that password to access your account, upon accessing your account we advise you to change your password. You are allowed one account and one account only. Any member found in possession of more than one account without prior consent from the BRO administration will be subject to disciplinary actions; not limited to having all offending accounts terminated. You are solely responsible for anything that happens on your account. If you believe there has been unauthorized use of your account you are to immediately notify staff of the event. At no time may you log into or sit another users account, anyone caught hacking accounts will be banned immediately.
Refund Policy:
BRO does not issue refunds. Any money donated to Brokenrealityonline in exchange for virtual items will be accepted as a donation in support of a free game.
Information Collection and Tracking:
BRO may use cookies to enhance and personalize your gaming experience and provide feedback that will help us improve the overall performance of the game. Cookies are not programs and do not contain any viruses. A cookie is a small parcel of text, uniquely assigned to you, that is delivered from a server to your web BRO browser. Most BRO browsers give the user the ability to turn cookies on/off. By turning cookies off it may affect certain features during game play.
Force majuere:
BRO shall not be responsible for any failure to perform its obligations under this Agreement, connectivity, loss of account information, if such failure is caused by events or conditions beyond BRO's reasonable control.
